LONDON, Nov 14 (Reuters) – A ruling by the High Court in London concluded that BHP could be held responsible for the collapse of a dam in southeastern Brazil in 2015. This case has been previously estimated by plaintiff attorneys to be worth up to \u00a336 billion ($48.32 billion). Hundreds of thousands of Brazilians, numerous local governments, and around 2,000 companies have filed lawsuits against BHP concerning the tragedy at the Fund\u00e3o dam in Mariana, managed by BHP in partnership with Vale Samarco. This disaster, deemed Brazil’s worst environmental incident, released a torrent of toxic mud, resulting in 19 fatalities, displacing thousands, inundating forests, and polluting the entire course of the Doce River. Judge Finola O’Farrell stated in her ruling that the decision to continue increasing the height of the dam despite safety concerns was the ‘direct and immediate cause’ of the collapse, establishing BHP’s liability under Brazilian law. The company has announced its intention to appeal the decision.
